PETERBOROUGH REGIONAL HEALTH CENTRE (PRHC) PRIVACY BREACH CLASS ACTION – STATUS UPDATE

This matter has progressed to the point where an agreement in principle has been reached to settle the claim. Before the matter can be settled, the Court will have to certify the claim as a class action and approve the settlement. On May 25, 2023, the Court approved a notice plan that provided for class members being advised of certain key information. Click here to see a copy of the full notice approved by the Court.
In summary, the settlement will see the Peterborough Regional Health Centre paying up to $988,550, which payment includes up to $650 to each class member who submits a valid claim. A virtual hearing has been scheduled before Justice Edwards of the Superior Court of Justice on August 30, 2023 for certification and approval of the settlement. If the settlement is approved, a further notice will be distributed that describes how class members may submit a claim to participate in the settlement.

A virtual hearing has been scheduled before Justice Edwards of the Superior Court of Justice on May 25th, 2023 for approval of a notice plan. The notice plan will set out, among other things, when and how class members have to be informed about the proposed settlement and how they can participate in the process if they so choose.

Peterborough Regional Health Centre (PRHC) Privacy Breach Class Action [H1]
Spiteri and Ursulak LLP has commenced a proposed class action against the hospital Peterborough Regional Health Centre (PRHC) and other defendants for breaches of patient privacy that occurred between 2011 and early 2012.
Between 2011 and early 2012, former employees of PRHC used the hospital database to inappropriately access the personal information of approximately 280 patients.
Supreme Court Decision Permits Proposed Class Action to Proceed
On October 29, 2015, the Supreme Court of Canada dismissed the defendants’ appeal of a decision in which the Ontario Court of Appeal ruled that patients should be permitted to sue hospitals and staff members for privacy breaches and not simply be restricted to making a complaint to the Information and Privacy Commissioner.
